Terms and Conditions

Introduction

  1. These Terms and Conditions (“Terms”) govern your use of the ShariahLab platform, website, mobile application, and any associated services (“Services”), owned and operated by Elzar Shariah Solutions Sdn. Bhd. (“Company”, “we”, “our”, or “us”).
  2. By accessing or using our Services, you agree to be bound by these Terms. If you do not agree with these Terms, you must immediately discontinue use of the Services.
  3. These Terms incorporate by reference our Privacy Policy and any other guidelines, notices, or disclaimers posted on the platform.

Definitions

  1. “Account” means a registered user profile created for access to the ShariahLab platform.
  2. “User” or “You” refers to any individual, entity, organization, or legal person accessing or using the Services.
  3. “Content” means all information, data, text, software, documentation, audio, video, graphics, or other materials published, displayed, or accessible via the Services.
  4. “Intellectual Property Rights” means patents, copyrights, trade names, trademarks, trade secrets, know-how, and other proprietary rights.
  5. “Authorized Bodies” include SACBNM, SACSC, AAOIFI, Majma’ Fiqh Islami, and other recognized Shariah institutions.

Eligibility and Registration

  1. You must be at least 18 years old and have the legal capacity to enter into binding contracts to use our Services.
  2. Organizations may register through an authorized representative who warrants they have authority to bind the entity to these Terms.
  3. You are responsible for maintaining the confidentiality of your login credentials and are liable for all activities conducted under your Account.

Use of Services

  1. ShariahLab grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the Services strictly in accordance with these Terms.
  2. You agree not to:
    • Use the platform for any unlawful, unethical, or fraudulent purpose;
    • Attempt to reverse-engineer, decompile, or gain unauthorized access to our systems;
    • Upload or transmit viruses or malicious code;
    • Infringe any third-party intellectual property rights;
    • Misrepresent religious or Shariah rulings obtained through the Services;
    • Use automated tools, bots, or scripts without prior authorization.
  3. Any breach of the above shall entitle us to suspend or terminate your Account without notice.

Shariah Disclaimers

  1. While ShariahLab uses verified datasets and authoritative sources, the platform is intended as a supplementary tool and not a substitute for professional Shariah advice.
  2. Decisions made using the Robo Shariah Adviser or any AI-generated output must be verified by qualified Shariah personnel or recognized bodies, especially in commercial or financial transactions.
  3. We disclaim all liability arising from reliance on AI-generated content that has not been independently reviewed or approved.

Intellectual Property Rights

  1. All content, software, architecture, algorithms, and databases within ShariahLab are the exclusive property of the Company or its licensors.
  2. Nothing in these Terms shall grant you any rights in or to the intellectual property other than the limited license stated under Clause 4.
  3. You may not reproduce, copy, distribute, modify, or create derivative works from any part of the platform without our prior written consent.

Subscriptions, Fees and Payments

  1. Some features of ShariahLab are provided free of charge; however, access to premium services may require payment of fees.
  2. Subscription plans and fee structures are outlined on our official website. Prices are subject to change with prior notice.
  3. All fees are non-refundable unless stated otherwise in a separate agreement. Invoices shall be payable within the timeframe specified.
  4. We may suspend access to premium services in the event of non-payment.

Data Privacy

  1. Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, store, and disclose your personal data.
  2. By using our Services, you consent to the collection and processing of your data in accordance with PDPA 2010 and any applicable privacy legislation
  3. You acknowledge that communications through the internet may not always be secure and that we are not liable for any unauthorized access beyond our reasonable control.

Third-party Links and Services

  1. ShariahLab may contain links to third-party websites, services, or content. We do not endorse or accept responsibility for these external platforms.
  2. Access to or use of third-party services is governed by their respective terms and conditions.
  3. We are not responsible for any loss, damage, or misrepresentation caused by third-party service providers integrated into our platform.

Service Availability and Maintenance

  1. We make commercially reasonable efforts to maintain uninterrupted access to the Services. However, availability may be affected by scheduled maintenance, technical failures, or unforeseen circumstances.
  2. We reserve the right to modify, suspend, or discontinue any part of the Services without liability or prior notice.
  3. Users will be notified in advance of major updates or disruptions wherever practicable.

Limitation of Liability

  1. To the maximum extent permitted by law, we shall not be liable for any:
    • Indirect, incidental, or consequential damages;
    • Loss of profits, data, or goodwill;
    • Errors in AI-generated content;
    • Decisions made solely based on platform output.
  2. Our total liability, whether in contract, tort, or otherwise, shall not exceed the amount paid by you (if any) in the last twelve (12) months for the use of Services.

Indemnification

  1. You agree to indemnify, defend, and hold harmless the Company, its affiliates, directors, officers, and employees from any claims, losses, or damages arising from:
    • Your violation of these Terms;
    • Use of the Services for unlawful purposes;
    • Infringement of intellectual property or rights of third parties;
    • Misuse or misrepresentation of ShariahLab content or advice.

Termination

  1. We reserve the right to terminate or suspend your access to the Services, without prior notice, if you breach any of the Terms or applicable laws.
  2. You may deactivate your Account at any time by contacting our support team. Upon termination:
    • Your license to use the Services is revoked;
    • Access to data or saved preferences may be deleted after a retention period;
    • Clauses concerning intellectual property, indemnity, and limitations of liability shall survive.

Governing Law and Jurisdiction

  1. These Terms shall be governed by and construed in accordance with the laws of Malaysia.
  2. Any dispute, controversy, or claim arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.
  3. Notwithstanding the above, we reserve the right to seek injunctive or equitable relief in any jurisdiction to protect our rights.

Miscellaneous

  1. Entire Agreement: These Terms constitute the entire agreement between the parties concerning the subject matter.
  2. Waiver: Any failure by us to enforce a provision shall not constitute a waiver of that right.
  3. Severability: If any provision is found unenforceable, the remaining provisions will remain in effect.
  4. Force Majeure: We shall not be liable for delays or failures caused by events beyond our reasonable control including, but not limited to, natural disasters, cyberattacks, government actions, or system outages.
  5. Language: These Terms may be published in Bahasa Melayu and English. In the event of inconsistencies, the English version shall prevail unless otherwise required by law.
